This type of permit, as its name suggests, is aimed at all those foreigners who have a family member (a citizen of the European Union or the European Economic Area) residing in Spain, and with whom they plan to meet and live in Spain.

In order for this permit to be granted, among other requirements, the applicant must be the spouse, registered partner or unregistered partner who maintains a sentimental relationship similar to that of a spouse, or a direct family member of the EU citizen or of his/her spouse or unmarried partner (descendants, ascendants).

Advantages of this permit

1º.- The card is normally applied for incountry, that is to say, with the EU citizen’s family member already in Spain.

2º.- It can be filed electronically with a digital certificate and by means of a lawyer, which speeds up the resolution.

3º.- It is granted, in principle, for a period of 5 years, extendable subsequently for another period of 10 years.

4º.- This permit allows its holder to work in Spain as long as it is valid, both as an employee and as a self-employed person.

5º. – It is a much simpler and quicker process than other residence permits.

6º.- Renewing or extending this card is also a very simple process, as long as the circumstances that allowed the initial granting of the Community Family Card are complied with.

7º.- With this permit, the Spanish citizenship can be obtained after the time of residence that corresponds to each specific case (5 years, 2 years or 1 year after obtaining the EU Family Card).

Requirements in 2021 for granting the EU Family Member Card

1º.- Being a family member of EU or European Economic Area citizen , entitled to reside in Spain for a period of more than 3 months.

2º.- The EU citizen shall be employed, self-employed, or hold a health insurance and sufficient financial means for the family unit, or shall be  a student with health insurance and sufficient resources for the family unit.

3º.- The family member intends to reside and live in Spain with the EU citizen for at least 6 months.

Which family members can apply for the residence card of an EU citizen family member?

1º.- Spouse or registered partner as per a Public Register held in a Member State of the European Union.

BOND PROOF: Certificate of marriage or registration of registered partnership, duly legalized or apostilled and translated into Spanish by a sworn translator.

2º.- Unregistered unmarried couple, proving that they maintain a relationship similar to that of a married couple.

BOND PROOF: Proving the existence of common descent through a birth certificate, legalized or apostilled and translated into Spanish by a sworn translator or  accreditation of cohabitation similar to the conjugal one during  at least one year. Any other means of proof of the existence of the sentimental relationship shall be admissible.

3º.- Descendants under 21 years of age of the EU citizen or of their spouse or registered partner, or descendants over 21 years of age of the EU citizen or of their spouse or registered partner, who continue to be economically dependent on the EU citizen and live with him/her, or who are disabled.

BOND PROOF: Legalized or apostilled birth certificate which shall be translated into Spanish by a sworn translator. In the case of descendants over 21 years of age, documentation proving that they live with the EU family member or that they are dependent persons (disabled).

4º.- Direct ascendants of the EU citizen or of his/her spouse or registered partner, who are economically dependent on the EU citizen and live under his/her care.

BOND PROOF: Certificate proving the family relationship with the EU citizen. The certificate shall be legalized or apostilled and translated by a sworn translator. Documentation accrediting the economic dependence of the EU citizen.

5º.- Special circumstances:

  • Any family members who are dependants of the EU citizen  in the country of origin.

ACCREDITATION: Documentation accrediting kinship with the EU family member and documentation accrediting economic dependence.

  • Any family members who live with the EU citizen in the country of origin. 

ACCREDITATION: Documentation accrediting the economic dependence of the EU citizen. Cohabitation shall be deemed to be accredited if there exists a reliable proof of 24 months of continuous cohabitation in the country of origin.

  • Any family member whose serious health condition or disability makes it strictly necessary for the EU citizen to provide them personal care.

ACCREDITATION: Documentation accrediting the relationship with the EU citizen and documentation accrediting the serious health condition or disability.

General documentation

1º.- Official application form.

2º.- Valid and complete passport of the family member.

3º.- Documentation accrediting the existence of a family relationship with the EU or European Economic Area citizen.

4º.- Medical certificate.

5º.- ID card of the Spanish citizen or certificate of registration of the citizen of the EU national whom they are accompanying or with whom they are meeting.

6º.- If the EU citizen is an employee, he/she must provide, at least, an Employment Contract.

7º.- If the EU citizen is self-employed, he/she must provide, at least, his/her registration in the Census of Economic Activities and registration with the Social Security.

8º.- If you do not work in Spain, you must prove sufficient financial means and a medical insurance.

9º.- If you are a student you must submit your studies enrolment, your public or private insurance, and a declaration of sufficient economic funds.
