Due to the development and technological innovation that the world has experienced in recent years, the traditional ways through which most economic and business activities were performed have undergone a great change: they have adapted and taken advantage of this technological development in order to improve their production in every way: from accelerating the process, to improve the sales channels of their products and the way consumers or companies may access to a certain professional activity.

In this sense, Spain is one of the countries that is currently implementing new technologies or innovations focused on improving the production process of companies, thus investing in new forms of business and markets which were unknown some years ago, but which nowadays represent one of the main economic sources of our country, thanks to private investment in R+D.  

This situation, together with the important technological development that we are experiencing in many sectors —from agriculture to IT or renewable energies—, makes it necessary in an increasingly globalized world to hire foreign professionals, specialized in these sectors and who are familiar with the latest innovations that their activity has experienced: high skilled or experienced professionals who allow the development and evolution in Spain of these business activities, as well as training our Spanish professionals.

In order to facilitate such recruitment the so-called Law 14/2013, Support for Entrepreneurs and their Internalization has come into force, formulated with the aim of promoting economic growth and investment in Spain, facilitating the entry and residence in Spain, for reasons of economic interest. 1.- This service is aimed at all those companies that are in the process of creation or growth, development or implementation of new technologies or innovative ways of working that improve their production system, and which, require the hiring of foreign professionals with high qualifications and extensive experience in this sector.

2.- For the recruitment of such professionals, we will provide advice to the HR departments of your company with regards to immigration matters when hiring foreign professionals. We will conduct a detailed study of the case and the feasibility and risks of obtaining the corresponding work permit.

3.- We will determine which is the most feasible option when requesting the permit for the foreign professional to be hired: we will assess the needs of the company and of the worker, the hiring characteristics (salary, work centre, type of contract), deadlines, etc.

4.- We will estimate the actual permit resolution deadlines, as well as the worker’s potential and effective incorporation in Spain.

5.- We will gather the documentation, fill in forms, and submit the application electronically by means of the administration’s digital application, through a duly registered lawyer.

6.- Once the file has been resolved, we will offer you advice and gather all the documentation so as to apply for a travel visa in the foreign worker’s country of origin.

7.- Once in Spain, we will apply for the foreign worker’s identification card: we will make an appointment for the application, gather all the documentation, and accompany the worker.

8.- Afterwards, we will request a new appointment so as to collect the foreign worker’s identification card, which will be ready about a month after its request

9.- Finally, once the migratory process is finished, we will register in our system the expiration date of the worker’s permit. Thus, if the company wishes to extend the permit, we can prepare the renewal documentation before it expires.

How can we get in touch?

Highly Qualified Professional

It is a work permit aimed at those professionals considered highly qualified (graduates, postgraduates, PhDs, etc.), or who have extensive experience in the activity for which they will be hired in Spain. This is a residence and work permit much simpler and more effective to obtain than any other provided for in the general immigration regime.

Advantages of this permit

1.- It can be requested when the worker is already in Spain (legally) or in their country of origin.

2.- The National Nature of the Employment  is not taken into account.

3.- It is submitted via telematic means with the digital application of the authorities.

4.- The body responsible for its resolution is the General Directorate for Migration, Large Companies and Strategic Sectors Unit.

5.- Once the application has been submitted, our authorities has a total period of 20 days to resolve the case in a positive or negative manner. If no decision has been received within this period, the permit will be considered as granted by positive administrative silence, in contrast to general regime work permits.

6.- It is granted for an initial period of 2 years, renewable for another 2 years and, after the third renewal, long-term residence may be requested.

7.- The residence permit of the worker’s family members can be requested at the same time as their own application or subsequently, with the same resolution deadlines as for the worker’s permit, as well as positive administrative silence, and they can work in Spain.

General Requirements in 2021

1.- The interested party may be in another country or in Spain to submit his/her application, as long as they are not here illegally.

2.- He/she must have no  criminal records.

3.- The application must be submitted by the contracting company or employer.

4.- The company must meet one of the following requirements:

  • More than 250 employees. 
  • A turnover higher than 50,000,000. EUR.
  • An equity higher than 43,000,000 EUR
  • Over 3,000,000 EUR of foreign investment within the last three years.
  • An investment stock higher than 3,000,000 EUR.
  • To be considered an SME from an strategic sector.
  • To have a project considered to be of general interest.
  • If none of the above is met, the foreign worker must hold a Bachelor’s or Postgraduate Degree.

5.- The foreign worker must hold a university degree, master’s degree or PhD which entitles him/her to access this residence permit or to accredit a minimum of 3 years of work experience in the same activity and perform similar tasks to those that he/she will perform in the contracting company. 

6.- The job position must be of executive or manager-level, in charge of professional teams, or positions which require very specific previous training or work experience.

7.- The worker’s wage shall be:

  • Executive or manager: a minimum of 50,000.-€/year.
  • Non-executive position requiring specific training or experience: 40,000 EUR/year.

8.- In any case, the Social Security Contribution Group must be either 1 or 2.

9.- This permit is linked to the company requesting it, so that if the foreign worker ceases to provide his/her services for that company, he/she will have to notify the company and request a new permit that fits his/her circumstances at that time.

Intra-Corporate Transfer

This permit is aimed at all those workers who provide services in a company located in a third country, and who are moving to Spain to provide services in a company that is part of the same business group as the company of origin, or in a headquarters of that company in Spain.

Advantages of this permit

1.- It can be requested when the worker is already in Spain (legally) or in his/her country of origin.

2.- The National Nature of the Employment  is not taken into account.

3.- It is submitted via telematic means with the digital application of the authorities.

4.- The body responsible for its resolution is the General Directorate for Migration, Large Companies and Strategic Sectors Unit.

5.- Once the application has been submitted, our authorities has a total period of 20 days to resolve the case in a positive or negative manner. If no decision has been received within this period, the permit will be considered as granted by positive administrative silence, in contrast to general regime work permits.

6.- It is granted for the duration of the transfer up to a maximum of two years, renewable for periods of another 2 years.

7.- The residence permit of the worker’s family members can be requested at the same time as their own application or subsequently, with the same resolution deadlines as for the worker’s permit, as well as positive administrative silence, and they can work in Spain.

General Requirements in 2021

1.- The interested party may be in another country or in Spain to submit his/her application, as long as they are not here illegally.

2.- He/she must have no  criminal records.

3.- The application must be submitted by the destination company in Spain.

4.- The worker maintains his/her employment contract in the company of origin, and continues to pay contributions in his/her country of origin. 

5.- Proof of a previous and continuous employment relationship of three months with one or more companies of the group.

There are two kinds:

  • ICT-EU transfer, aimed at managers, specialists (transfer up to a maximum of 3 years) and trainee employees (transfer up to a maximum of 1 year).
  • National Intra-corporate Transfer: Transfer of workers for the execution of a contract or transfer of workers for a professional relationship.
